1. Special Conditions for Dahlia Tubers
PLEASE READ BEFORE PURCHASING. ONLY PURCHASE OUR TUBERS IF YOU AGREE TO THESE CONDITIONS.

NZ-Grown Only: All tubers are grown locally in New Zealand during our summer season; we do not import.

Quality Assurance: We take the utmost care to ensure our plants and tubers are healthy and disease-free. Due to the prevalence of dahlia disease in NZ and the difficulty in testing, we cannot guarantee complete freedom from disease.

Dispatch Condition: Tubers will have a visible eye or growing shoot. If the shoot breaks during transit, another will grow in its place.

Images: All dahlia images on our website are our own from the last several growing seasons.
2. Agreement to Terms
By accessing or using our website and services (“Services”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our Services. These Terms incorporate all policies linked within, including our Refund & Returns Policy.
3. Account Requirements

You must be at least the legal age of majority in your place of residence.

You agree to provide accurate, complete, and current account, purchase, and payment details.

4. Product Descriptions

We aim for accurate representation but cannot guarantee that product colours or appearances will exactly match due to device settings.

We reserve the right to change product descriptions or discontinue items without notice.
5. Orders

Placing an order is an offer to purchase. We accept orders only after payment is processed and confirmed.

We reserve the right to decline, cancel, or modify orders at our discretion.

Orders are subject to our Refund & Returns Policy.
6. Pricing & Payment

Prices are in NZD unless otherwise stated, and may change without notice.

Posted prices exclude taxes, shipping, and duties unless stated.

You warrant that payment details are accurate and authorized for use.
7. Shipping & Delivery

Estimated delivery times are not guaranteed.

Title and risk pass to you when the order is handed to the carrier.

We are not responsible for delays caused by carriers, customs, or events beyond our control.
- Due to the uncertainty of future freight costs, please note that if carrier prices increase significantly between the time of your order and shipping, we may need to contact you to arrange additional payment prior to dispatch.
8. Intellectual Property

All content, designs, trademarks, and images (including dahlia photographs) are owned by Chaos Blooms or its licensors and are protected by law.

You may not copy, reproduce, modify, or distribute content without written permission.

Shopify trademarks and technology are owned by Shopify and used under license.
9. Third-Party Tools & Links

Optional tools and linked websites are outside our control and are used at your own risk.

We are not responsible for third-party content, transactions, or policies.
10. Relationship with Shopify
Our Services are hosted by Shopify. Purchases are made directly with Chaos Blooms. Shopify is not responsible for transactions, products, or services you receive from us.
11. Feedback & Submissions

If you submit suggestions, reviews, or other content, you grant us a worldwide, royalty-free license to use and publish it.

Do not submit ideas or works you wish to protect without a signed agreement in place.
12. Prohibited Uses
You may not use the Services to:

Violate laws or infringe rights.

Distribute malware, spam, or offensive content.

Harvest data or engage in automated scraping.

To the fullest extent permitted by law, Chaos Blooms’ total liability for any claim is limited to the amount you paid for the product or service in question.

You agree to indemnify and hold harmless Chaos Blooms, Shopify, and affiliates against claims arising from your breach of these Terms or your misuse of the Services.

These Terms are governed by New Zealand law, and disputes shall be resolved in NZ courts.

We may update these Terms at any time. Continued use after changes are posted constitutes acceptance.
